These Terms & Conditions apply to your use of this website operated by Switchboard Thermal Testing ("Switchboard Thermal Testing", "we", "us" or "our").
By accessing or using this website, submitting an enquiry, requesting a quote, or otherwise dealing with us through this website, you agree to these Terms & Conditions and acknowledge our Privacy Policy.
If you do not agree with these Terms, you must not use this website or submit an enquiry.
1.About Switchboard Thermal Testing
Switchboard Thermal Testing operates a website that provides information, enquiry handling, quote request and connection services for switchboard thermal imaging, electrical thermography and related electrical inspection services.
Depending on the nature and location of your enquiry, we may:
- refer your enquiry to an independent electrician, thermographer, electrical contractor or service provider;
- connect you with a suitable third-party provider who may contact you directly;
- assist with coordinating an inspection or report through a third-party provider; or
- provide general information about switchboard thermal imaging and related services.
Unless we expressly confirm otherwise in writing, Switchboard Thermal Testing does not personally perform the electrical inspection, thermal imaging inspection or electrical testing work. The inspection, testing and reporting work is performed by the relevant third-party provider.
2.No emergency or urgent electrical service
This website is not an emergency electrical service.
If there is an immediate risk to life, property, electrical safety, fire safety or site safety, you should contact emergency services, your electricity distributor, a licensed electrician or the relevant authority immediately.
You must not rely on this website as a substitute for urgent electrical, engineering, fire safety, workplace safety or professional advice.
3.Enquiries and referrals
When you submit an enquiry, you authorise us to use the information you provide to respond to your request, assess your enquiry, contact you, provide information, and refer or pass your enquiry to a relevant third-party provider.
You understand and agree that your name, contact details, property or site details, business details, enquiry details and any other information you submit may be shared with electricians, thermographers, electrical contractors or service providers for the purpose of responding to your enquiry, providing a quote, arranging an inspection, completing the requested service or issuing a report.
We may choose not to refer, accept or progress an enquiry for any reason, including if we believe the enquiry is outside the locations, services, risk profile, availability or capability of our provider network.
4.Third-party providers
Third-party electricians, thermographers, electrical contractors and service providers are independent businesses.
Unless expressly stated otherwise in writing:
- they are not our employees, officers, partners or agents;
- they are responsible for their own licences, registrations, insurances, qualifications, equipment, safety procedures, pricing, availability, workmanship, reports and compliance obligations;
- they are responsible for assessing whether they can legally and safely perform the requested work;
- any contract for inspection, testing, reporting or electrical services is between you and the relevant third-party provider; and
- we do not control the way the third-party provider performs the inspection or service.
We may take reasonable steps to refer enquiries to providers we consider suitable, but we do not guarantee the conduct, quality, availability, pricing, advice, workmanship, report content, licences, qualifications or insurance of any independent third-party provider.
5.Quotes and pricing
Any price, estimate or quote displayed on this website, communicated by us, or provided by a third-party provider is indicative only unless clearly stated to be final and confirmed in writing.
Pricing may depend on factors including location, site conditions, switchboard access, number of switchboards, urgency, property type, business type, after-hours access, provider availability, equipment required, reporting requirements and the complexity of the inspection.
Final pricing should be confirmed before work begins. You are responsible for reviewing and accepting any quote or price before proceeding.
6.Payments and refunds
Where payment is made directly to Switchboard Thermal Testing, the payment terms, inclusions, exclusions and refund position will be as stated at the time of purchase or in writing.
Where payment is made directly to a third-party provider, the provider is responsible for its own payment terms, invoices, receipts and refunds.
Refunds, cancellations or changes will be handled by the party that received the payment, subject to the terms provided at the time of purchase and any rights you may have under the Australian Consumer Law or other applicable laws.
Nothing in these Terms limits any refund, replacement, cancellation or remedy rights you may have under laws that cannot be excluded.
7.Inspection reports and limitations
Any switchboard thermal imaging report, electrical thermography report or inspection report is based on the conditions observed at the time of inspection.
Unless expressly stated in the report, a report is not:
- a guarantee that the switchboard, electrical system or site is safe;
- a guarantee of future performance;
- a full electrical audit;
- a certificate of compliance;
- a fire safety certificate;
- an engineering certification;
- a substitute for ongoing maintenance, testing or inspection; or
- a substitute for advice from a licensed electrician, engineer, fire safety professional or other qualified professional.
Thermal imaging and electrical inspections may be affected by site access, load conditions, equipment condition, switchboard covers, environmental conditions, operator judgement and other practical limitations.
You are responsible for reading the report, following up any recommendations, and obtaining further professional advice where required.
8.Your responsibilities
You must:
- provide accurate, complete and current information when submitting an enquiry;
- ensure you have authority to request an inspection or provide site details;
- ensure safe, lawful and reasonable access to the switchboard, electrical room, meter room, property or site;
- disclose any relevant hazards, access restrictions, induction requirements, site rules, asbestos risks, security requirements or safety procedures;
- comply with any reasonable instructions from the provider;
- ensure a suitably authorised person is available where required; and
- not use this website for any unlawful, misleading, fraudulent or harmful purpose.
We are not responsible for delays, failed attendance, additional costs or inability to complete work caused by inaccurate information, unsafe access, restricted access, unavailable authorised persons, site conditions or matters outside our reasonable control.
9.Website information
The information on this website is provided for general information only.
While we aim to keep the website accurate and up to date, we do not guarantee that the content is complete, current, error-free or suitable for your specific circumstances.
Website content is not electrical advice, engineering advice, fire safety advice, legal advice, workplace safety advice or professional advice. 10.No guarantee of availability or outcome
We do not guarantee that:
- a provider will be available in your area;
- a provider will accept your job;
- a quote will be provided within a particular timeframe;
- an inspection can be completed by a particular date;
- a report will produce a particular result;
- a defect, hotspot, risk or issue will be identified; or
- the requested service will meet the requirements of your insurer, landlord, tenant, body corporate, auditor, regulator or other third party.
You are responsible for confirming whether a proposed inspection or report meets any specific external requirement before proceeding.
11.Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or protection you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
Where our liability cannot be excluded but can lawfully be limited, our liability is limited, at our option and to the extent permitted by law, to:
- resupplying the relevant services;
- paying the cost of resupplying the relevant services; or
- refunding the amount paid to us for the relevant services.
12.Limitation of liability
To the maximum extent permitted by law, Switchboard Thermal Testing is not liable for any loss, damage, cost, expense, claim or liability arising from or connected with:
- your use of this website;
- your reliance on website content;
- any delay in responding to or referring an enquiry;
- the acts, omissions, advice, pricing, availability, delays, workmanship, reports or conduct of any third-party provider;
- inaccurate, incomplete or misleading information you provide;
- site access issues, unsafe conditions or site-specific restrictions;
- any decision you make based on a quote, report, recommendation or inspection; or
- events outside our reasonable control.
To the maximum extent permitted by law, we exclude liability for indirect, consequential, special, incidental, economic or business losses, including loss of profit, loss of revenue, loss of opportunity, loss of goodwill, business interruption, increased operating costs or loss arising from delay.
Where we are liable to you and that liability cannot be excluded, our total aggregate liability is limited to the amount paid by you directly to Switchboard Thermal Testing for the relevant service giving rise to the claim, except where a greater amount is required by law.
13.Indemnity
To the maximum extent permitted by law, you agree to indemnify Switchboard Thermal Testing against any loss, damage, cost, expense, claim or liability arising from:
- your breach of these Terms;
- inaccurate, incomplete or misleading information you provide;
- your unlawful, negligent or wrongful conduct;
- your failure to provide safe or lawful access to a site;
- your failure to disclose relevant site risks, hazards or restrictions; or
- your misuse of this website.
This indemnity does not apply to the extent the loss is caused by our fraud, wilful misconduct, negligence or breach of law.
14.Privacy
Your use of this website and submission of personal information is also governed by our Privacy Policy.
By submitting an enquiry, you acknowledge that your information may be collected, used and disclosed in accordance with our Privacy Policy, including disclosure to third-party electricians, thermographers, electrical contractors, service providers, payment processors, website providers, analytics providers and administrative service providers where reasonably required.
15.Intellectual property
All content on this website, including text, graphics, logos, images, icons, page layouts, design elements and other materials, is owned by or licensed to Switchboard Thermal Testing unless otherwise stated.
